As of today, same sex couples who were not married prior to the passage of Proposition 8 can register as domestic partners and take advantage of the benefits provided by California law. There is currently a case in the California courts, Perry v. Schwarzenegger, challenging the validity of Proposition 8. This case is extremely important and could have implications for the status of same sex marriage across the country.
